considerato che la sentenza del Tribunale federale ha ripristinato la causa nello stato in cui si trovava prima dell'emanazione della sentenza 26 giugno 1996 di questo Tribunale;

constatato che la succitata sentenza del Tribunale federale sancisce in via definitiva la legittimità della licenza edilizia 10 novembre 1995 rilasciata dal municipio di __________ a __________ e __________;

rilevato che in pratica rimangono unicamente da definire la tassa di giustizia e le ripetibili di sede cantonale;

ritenuto che le particolari circostanze del caso concreto permettono di esentare la ricorrente dalla tassa di giustizia;

che le ripetibili devono invece esserle interamente addossate in quanto soccombente;

visti gli art. 21 LE; 39 RLE; 3, 18, 28, 31, 60, 61 PAmm,

dichiara e pronuncia:

  1. Il ricorso è respinto.

  2. Non si prelevano né tasse di giudizio, né spese.
