statuendo sull’istanza di riesame 31 luglio 2001 del

RI 1

contro

la sentenza 16/18 luglio 2001 del Tribunale cantonale amministrativo, che annulla la decisione 6 giugno 2001 del municipio di RI 1 con la quale affida alla CO 2 lo smaltimento dei rifiuti vegetali sino al 31 dicembre 2001;

preso atto che il 13 dicembre 2004 il ricorrente ha comunicato di ritirare l'istanza di riesame;

ritenuto che i resistenti CO 1 si sono avvalsi di una consulenza legale, per cui si giustifica la corresponsione di un’indennità per ripetibili;

considerato pertanto che il procedimento è così esaurito;

decreta:

1.Il ricorso è stralciato dai ruoli.

2.Non si prelevano né tasse, né spese.

Il ricorrente verserà ai resistenti CO 1 l’importo di fr. 100.- a titolo di ripetibili.
