che le insorgenti hanno chiesto di includere i mapp. __________, __________, __________e __________, attributi alla zona agricola, nella zona edificabile __________;

che, all'udienza 15 giugno 1994, il procedimento è stato sospeso in vista di una variante del piano volta a soddisfare, parzialmente, le domande delle insorgenti, per il tramite dell'assegnazione alla zona __________ dei mapp. __________, __________, __________, __________, __________ e __________;

che, con risoluzione 9 luglio 2002, cresciuta in giudicato, il Consiglio di Stato ha approvato una variante del piano regolatore che contempla l'attribuzione di questi ultimi fondi, oltre che del mapp. __________, alla zona residenziale __________;

che il gravame di cui trattasi è pertanto divenuto privo di oggetto;

che esso va dunque stralciato dai ruoli;

che le insorgenti, consenzienti allo stralcio, protestano tuttavia spese e ripetibili (cfr. scritto 9 ottobre 2002); il municipio, pure d'accordo con lo stralcio, ne chiede invece la compensazione (cfr. lettera 11 novembre 2002);

che, nell'ambito del presente procedimento, alla variante del piano regolatore approvata il 9 luglio 2002 dal Consiglio di Stato dev'essere conferito il valore di atto di parziale acquiescenza del comune nei confronti delle domande delle ricorrenti;

che, di conseguenza, i ricorrenti, assistiti da un patrocinatore, hanno diritto al versamento di ripetibili da parte del comune, il quale dev'essere considerato soccombente giusta l'art. 31 PAmm (cfr. Borghi/Corti, Compendio di procedura amministrative ticinese, ad art. 31 n. 2; inoltre Merkli/Aeschlimann/Herzog, Kommentar zum bernischen VRPG, Berna 1997, ad art. 110 cpv. 1 n. 3);

che le ripetibili vanno commisurate al grado (parziale) di soccombenza del comune;

che il Tribunale non preleva una tassa di giudizio (art. 28 PAmm);

  1. Il ricorso è stralciato dai ruoli.

  2. Non si preleva una tassa di giudizio. Il comune di __________ è condannato a versare alle ricorrenti fr. 1'000.-- per ripetibili.
