W.________ challenged a 5-day suspension of unemployment benefits imposed after he missed an ORP counseling appointment. He produced a medical certificate and the doctor confirmed a 100% incapacity to work on the relevant day due to a dental abscess. The court accepted the certificate, held that the medical incapacity prevented sanctioning under the unemployment insurance rules, and found that the mere failure to notify the ORP that morning was insufficient. The appeal was allowed, the suspension decision annulled, and no fees or costs were charged.
Art. 17 al. 3 and Art. 30 al. 1 let. d LACI; absence from a counseling appointment due to proven medical incapacity does not justify suspension of unemployment benefits. A suspension presupposes a sanctionable failure to comply with control duties; where the insured establishes that he or she was unable to attend, the missed appointment cannot be treated as a breach. A later failure to notify the ORP immediately may be reproached, but it is not by itself sufficient to ground a suspension in the absence of a sanctionable omission. The probative value of a medical certificate confirmed by the issuing doctor prevails absent concrete reasons to doubt it (consid. 4).
403 TRIBUNAL CANTONAL ACH 112/08 - 46/2010 C O U R D E S A S S U R A N C E S S O C I A L E S
