Whether the lawyer had standing to appeal the first-instance costs award in his own name
The lawyer had no personal standing to appeal because the costs claim belonged to the successful party, and distraint of costs in favor of counsel presupposes a finally determined costs award and action by the party.
Art. 62 OELP grants costs to the successful party as reimbursement of professional fees; the lawyer's right under Art. 46 LPAv is a legal assignment of the client's already determined costs claim and cannot be invoked before the costs have been definitively fixed. Under the procedural standing rules, only the party, not a third party, may appeal.
