Whether the appeal, which also served as a request for written reasons, was timely under Art. 239(2) CPC and Art. 138(3)(a) CPC.
The pronouncement was deemed notified on 2015-12-02, and the ten-day period for requesting reasons expired on 2015-12-14; the appeal filed on 2015-12-22 was therefore late.
Because the appellant had attended the hearing and had requested mail holding, it had to expect the pronouncement. Under Art. 138(3)(a) CPC, notification occurred at the end of the seven-day postal retention period, regardless of the later actual pickup. The request for reasons was consequently out of time.
