Whether the appeal was admissible as a nullity appeal although a reform appeal was available
A reform appeal was the proper remedy because the Civil Chamber had applied cantonal public-law rules together with federal private-law norms; a nullity appeal was therefore subsidiary and could not be used for the appellant's factual and evidentiary arguments.
Under Arts. 451a and 452 CPC, the Chamber had full review only in a reform appeal; because the case involved concurrent application of cantonal and federal law, the appellant had to use that remedy. Since he filed only a nullity appeal, the court could not examine his arguments.
