Omnilex summary

The Zurich High Court dealt with a complaint against a prosecutor’s dismissal order concerning compensation consequences. After the appellant informed the court that he had already been compensated by the complainant, the court held the appeal to be moot and did not enter into it. Because the appeal had been filed in good faith, no costs were imposed. The appellant was nevertheless awarded CHF 218 from the court treasury as compensation for the appellate proceedings, calculated for a purely pecuniary dispute under the applicable fee provisions.

Omnilex headnote

Art. 426 Abs. 3 and Art. 434 StPO; mootness of a criminal complaint proceedings after extrajudicial compensation and the consequences for costs and party compensation. If the appellant’s grievance is extinguished during the appeal because the underlying compensation issue has been settled elsewhere, the appellate court may decline to enter into the complaint for lack of a live dispute. When the appeal was filed in good faith and the appellant could not foresee the later extrajudicial settlement, court costs may not be imposed. In such circumstances, compensation for the appellate proceedings is payable from the court treasury; for purely pecuniary interests, the amount is to be fixed according to the relevant fee schedule and the dispute value (consid. implicit).

Key legal question

Whether the appeal had become moot after the appellant was compensated by the complainant

Extracted holding

The appeal was no longer to be examined because the matter had become moot.

Extracted reasoning

Once the appellant reported that he had been compensated elsewhere, there was no remaining need to decide the compensation issue.

Key legal question

Whether court costs should be charged for the appellate proceedings

Extracted holding

No costs were imposed because the appellant had filed the appeal in good faith and could not have been expected to know that compensation would be decided elsewhere.

Extracted reasoning

Since the appeal was filed in good faith and the proceedings became moot only later, costs could not be charged to him.

Key legal question

Whether the appellant was entitled to compensation for the appellate proceedings

Extracted holding

The appellant was awarded compensation from the court treasury.

Extracted reasoning

By analogy to Art. 426(3) and 434 CCP, compensation was due; for purely financial interests it was set at CHF 200 plus VAT under the applicable fee rules.
