Tenor

Die Beklagte wird verurteilt, den Kläger von einer Restforderung der Firma B GmbH & Co. KG in Höhe von 1.238,28 DM aus der Mietwagenrechnung Nr. #####/#### vom 05.10.1999 freizustellen.

Die Kosten des Rechtsstreites trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Der Beklagten wird nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages abzuwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in gleicher Höhe leistet. Sicherheiten können auch in Form einer selbstschuldnerischen Bürgschaft einer deutschen Großbank oder öffentlichen Sparkasse erbracht werden.
