In dem Rechtsstreit

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 27.05.2010
für Recht erkannt:
Die Beklagte wird unter Klageabweisung im Übrigen verurteilt, an die Klägerin 222,63 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 02.10.09 und vorgerichtliche Rechtsanwaltskosten von 39,- Euro zu zahlen.
Die Kosten des Rechtsstreits werden der Klägerin zu 27 % und der Beklagten zu 73 % auferlegt.
Das Urteil ist vorläufig vollstreckbar.
