Die Beklagte wird verurteilt, einer Mieterhöhung für die Wohnung B-Platz x, C-Stadt, erstes Obergeschoss, von bisher netto 443,81 € auf netto 504,17 € beginnend ab dem 01.10.2016 zuzustimmen

Die Kosten des Rechtsstreits hat die Beklagte zu 90%, die Klägerin zu 10% zu tragen.

Das Urteil ist vorläufig vollstreckbar. Die Beklagte kann die Vollstreckung der Klägerin abwenden, indem sie Sicherheit leistet in Höhe von 110 % des auf Grund des Urteils vollstreckbaren Betrages, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
