Die Beklagte wird verurteilt, an den Kläger 59,68 Euro nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz der EZB seit dem 17.07.2009 zu zahlen sowie den Kläger von seiner Verbindlichkeit aus der Rechtsanwaltsgebührenrechnung der Rechtanwaltskanzlei T pp., Menden, vom 03.09.2009 (Rechnungsnummer: #####/####) in Höhe von 39,00 Euro freizustellen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden dem Kläger zu 69 % und der Beklagten zu 31 % auferlegt.

Dieses Urteil ist rechtskräftig und vollstreckbar.
