Tenor

  1. In Abänderung des gerichtlichen Vergleichs des

Amtsgerichts -Familiengericht - Bergheim vom 08.04.2003

-AZ: 63 F 23/03 — wird festgestellt, dass der Kläger dem Beklagten ab 01.05.2004 keinen Unterhalt mehr schuldet.

  1. Der Beklagte wird verurteilt, an den Kläger, den ab 01.05.2004 monatlich

gepfändeten Kindesunterhalt in Höhe von 240,00 EUR zurückzuzahlen.

  1. Die Kosten des Rechtsstreits hat der Beklagte zu tragen.

  2. Das Urteil ist vorläufig vollstreckbar.

  3. Dem Beklagten wird gestattet, die Vollstreckung gegen Sicherheitsleistung in Höhe von 1 800,00 EUR abzuwenden, falls nicht der Kläger vor der Voll-streckung Sicherheit in entsprechender Höhe leistet.
