Kerpen District Court partially invalidated the owners’ meeting resolution of 2 April 1996 approving the 1994/95 annual accounts. It held that the resolution could not stand insofar as individual accounts indiscriminately offset all income against apportioned expenses, and required the accounts to state the account balances correctly. The court also declared the discharge granted to the property manager invalid. Procedural costs were imposed on the manager, but the participants were not awarded reimbursement of their extrajudicial costs.
