Omnilex summary

The plaintiff brought a claim concerning smoke entering her rooms from the defendant’s smoking on his apartment balcony. The Bonn District Court dismissed the claim under BGB § 1004. It considered that smoking is socially accepted and that smoking on a balcony takes place practically outdoors, within the defendant’s freedom of action. The plaintiff had to tolerate this interference, just as she could not prevent smoke from a passerby’s cigar or emissions from vehicles outside her apartment. The plaintiff was ordered to bear the costs. The judgment is provisionally enforceable.

Omnilex headnote

BGB § 1004; the general freedom of action protected by Art. 2 GG must be weighed against a neighbor’s interest in protection from smoke. Given the social acceptance of smoking, smoking on an apartment balcony, which is practically outdoors, falls within the smoker’s constitutionally protected sphere of conduct. A neighbor must tolerate resulting smoke where comparable emissions from a passerby smoking outside or from passing motor vehicles would also have to be accepted. In the circumstances stated, the interference does not entitle the neighbor to prevent balcony smoking by way of an injunction.

Tenor

Die Klage wird abgewiesen.

Die Klägerin trägt die Kosten des Rechtsstreits. Das Urteil ist vorläufig vollstreckbar.
