Tenor

Unter Abweisung der Klage im übrigen wird die Beklagte verurteilt, an den Kläger 4.069,93 € nebst Zinsen in Höhe von 5 % über dem Basiszinssatz seit dem 11.03.2003 zu zahlen.

Von den Kosten des Rechtsstreits tragen der Kläger 18 % und die Beklagte 82 %.

Das Urteil ist vorläufig vollstreckbar, für den Kläger jedoch nur gegen Sicher-heitsleistung in Höhe von 5.700,00 €. Der Kläger darf die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 250,00 € abwenden, wenn nicht die Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
