Omnilex summary

The applicant challenged resolutions adopted by the condominium owners' meeting on 21 August 2003. The Bonn Local Court invalidated the restriction to a single communal tumble dryer because there was sufficient space for more. It also invalidated the waste-disposal prohibition insofar as it barred commercial residual waste from the community residual-waste bin and recyclable waste from the corresponding recycling bins, provided waste separation was observed. The remaining applications were dismissed. The decision's stated principles support the approval of a security grille after repeated break-ins where keys were offered to other owners, and an equalisation payment where a commercial unit's separate hot-water tank intensifies use of central heating. The applicant bears 75% of court costs.

Omnilex headnote

WEG §§ 10, 13, 14, 43 and 46; proper administration of condominium property: A resolution restricting use of a communal laundry room to one tumble dryer, despite sufficient space for additional machines, does not accord with proper economic management. Commercial waste may be disposed of using the owners' association's bins where residual and recyclable waste are correctly separated. An additional grille door securing an apartment entrance may be approved following repeated break-ins where other co-owners are offered keys. Where a separate hot-water tank serving a commercial unit is operated through the central heating system, the owners' association may claim an equalisation payment for the intensified use of the system.

The resolution permitting only one communal tumble dryer was invalid.

Sufficient space was available for additional dryers, so limiting the facility to one dryer did not accord with proper economic management.

The prohibition on disposing of commercial residual waste and recyclable waste in the corresponding community bins was invalid.

Commercial waste may be disposed of through the community bins if residual and recyclable waste are separated appropriately.

The challenge to the approval was rejected.

The additional security door was justified following repeated break-ins, and keys were offered to the other co-owners.

The community was entitled to compensation for the intensified use of the central heating system.

Operating a separate hot-water tank for the commercial unit through the central heating system intensified its use and warranted an equalisation payment.
