In dem Rechtsstreit

hat das Amtsgericht Bonn auf die mündliche Verhandlung vom 20.02.2009 für Recht erkannt:

Die Beklagten werden verurteilt, im Bereich der Gartenfläche innerhalb der Wohnungseigentümergemeinschaft M -weg ##-##, L C -Str. ##-##, ##### C (Gartenfläche hinter dem Gebäude zur M-straße hin) folgende baulichen Anlagen zu entfernen:

Terrasse mit Steinplattenbelag,

Holz-Gartenhaus (Geräteschuppen) mit Regenrinne und Regentonne.

Die Beklagten werden weiter verurteilt, nach Entfernung der zu Ziff. 1 genannten baulichen Anlagen, den ursprünglichen Zustand wieder herzustellen.

Die Beklagten tragen die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar.

Den Beklagten bleibt nachgelassen, die Vollstreckung durch die Kläger gegen Sicherheitsleitung i.H.v. 1.200,00 € abzuwenden, wenn nicht die Kläger vor der Vollstreckung Sicherheit in gleicher Höhe leisten.
