Tenor

Der auf der Eigentümerversammlung vom 03.03.2009 zu TOP 3 gefasste Beschluss wird für ungültig erklärt.

Es wird festgestellt, dass die Kündigung des Verwaltervertrages vom 03.03.2009 unwirksam ist.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 75 % und die Beklagten zu 25%.

Das Urteil ist vorläufig vollstreckbar. Jede Partei kann die Vollstreckung durch Sicherheitsleistung i.H.v. 110 % des jeweils zu vollstreckenden Betrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in Höhe von 110 % des aufgrund des Urteils vollstreckbaren Betrages geleistet hat.
