Tenor

Die Beklagte wird verurteilt, an den Kläger 536,78 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 14.03.2009 zu zahlen. Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger 15 % zu und die Beklagte zu 85 %.

Das Urteil ist vorläufig vollstreckbar. Der jeweilige Vollstreckungsschuldner kann die Vollstreckung durch den jeweilige Vollstreckungsgläubiger durch Sicherheitsleistung in Höhe von 110% des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht der Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
