The plaintiff brought a civil claim against the defendant arising from damage to a textile item entrusted for cleaning. Ziff. 2 der Lieferbedingungen des Deutschten Textilreinigungsgewerbes findet entsprechende Anwendung, wenn an einem Textilstück, das der Kunde zur Reinigung gibt, ein Schaden wegen der Beschaffenheit anderer Textilstücke eintritt, die im gleichen Reinigungsgang mitgereinigt wurden.
Der Beklagte wird verurteilt, an den Kläger 187,50 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 11.10.2008 zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 49 % und der Beklagte zu 51 %.
Das Urteil ist vorläufig vollstreckbar.
