Omnilex summary

A claimant sued a telecommunications provider for an itemized connection record under a contract that included a flat rate. The Bonn District Court dismissed the claim, holding that the customer had no right to an itemized record under § 45e TKG and no information claim under § 34 BDSG in this situation. The claimant was ordered to bear the costs. The judgment was declared provisionally enforceable, subject to the stated security provisions, and leave to appeal was granted.

Omnilex headnote

§ 45e TKG; § 34 BDSG; entitlement to itemized connection records and access to personal data under a telecommunications flat-rate contract. Where the parties have agreed on a flat rate, the customer has no claim against the telecommunications provider under § 45e TKG for an itemized connection record. Nor does § 34 BDSG establish an information claim for that record in this contractual setting.
