Omnilex summary

In proceedings for the compulsory auction of a residential property to dissolve co-ownership, B L, one of the two half-share owners, remained the highest bidder with a cash bid of €70,000. The Bonn Local Court awarded the property to him subject to the continued existence of registered rights II/5, II/7, II/9 and II/12. The bid amount payable bears 4% interest from the date of the ruling, due with interest by the distribution date. The bidder must also bear the costs of the ruling. The minimum bid was drawn up using the lowest-bid solution.

Omnilex headnote

Under §§ 50 and 51 ZVG, a priority conveyance notice (Auflassungsvormerkung) must be taken into account in determining the minimum bid where it constitutes a prior right. The additional payment amount is measured by the value of the property even if the likelihood that the underlying claim exists or can be enforced is low. In valuing a right of pre-emption, the court set the value at 2% of the market value.
