Omnilex summary

The debtor objected on 20 February 2014 to the bailiff’s order of 9 February 2014 directing entry in the debtors’ register. The court upheld the objection and set aside the entry order. It stated that an entry impediment exists where, within the two-week period under ZPO § 882d, the debtor proves that the creditor has been satisfied or that an installment agreement has since been reached. Because no entry would now take place, the interim suspension ordered on 24 February 2014 became moot.

Omnilex headnote

ZPO § 882d; impediments to entry in the debtors’ register: An impediment to entry must be taken into account where, within the statutory two-week period, the debtor proves that the creditor has been satisfied or that the parties have meanwhile concluded an installment-payment agreement. Such circumstances therefore prevent the entry order from taking effect when established within that period.

An entry impediment exists if, within the two-week period under ZPO § 882d, the debtor proves that the creditor has been satisfied or that an installment agreement has since been made.

The court set aside the entry order on the debtor’s objection. The decision’s stated legal principle recognizes timely proof of satisfaction or a subsequent installment agreement as an impediment to entry.

The interim suspension became moot because no entry will now be made.

Setting aside the entry order removed the basis for any further entry.
