Omnilex summary

The Bonn District Court maintained its 28 January 2014 acknowledgment judgment, removing the reservation, and ordered the defendant to pay the further costs. The court held that combining property tax and street cleaning in one utility-charge statement item did not render the statement formally invalid. It also concluded that water ingress making a 50 m² annex and two cellar rooms unusable, together with noise from drying equipment affecting the main dwelling, justified a 30% rent reduction.

Omnilex headnote

BGB §§ 535, 536, 556(1); § 2 BetrKV; formal requirements for utility-charge statements and rent reduction for impairment of use. Combining property tax and street cleaning under a single statement item does not, by itself, make a utility-charge statement formally invalid. Where water ingress renders an annex and cellar rooms unusable and drying equipment causes noise impairing the main dwelling, the extent of the loss of use and the additional disturbance may justify a rent reduction; in the circumstances described, a 30% reduction is appropriate.
