Omnilex summary

The Bonn District Court ordered the defendant vehicle workshop to pay the plaintiff €2,230.15, with interest from 10 August 2013, and to bear the costs of the proceedings. The workshop had failed to perform the basic adjustment of the vehicle’s parking brake. The court held that this failure so undermined the customer's trust that requiring the customer to set a deadline for the workshop to remedy the defect would be unreasonable. The judgment is provisionally enforceable against security of 110% of the amount to be enforced.

Omnilex headnote

BGB Art. 634 no. 4, Art. 280 paras. 1 and 3, Art. 636; defective vehicle repair and the requirement to set a deadline for cure. A customer need not necessarily afford the contractor an opportunity to cure before claiming damages. Where the contractor’s failure is sufficiently serious to destroy the customer’s confidence in proper performance, requiring the customer to set a deadline for remedial work may be unreasonable. The failure of a motor-vehicle workshop to perform the basic adjustment of a parking brake can, in itself, sufficiently undermine that confidence to dispense with a deadline under § 636 BGB.
