Omnilex summary

The debtor applied to open insolvency proceedings. The Bonn Local Court refused the application because the debtor’s assets were expected to be insufficient to cover the costs of proceedings, and ordered the debtor to bear those costs. The decision applied section 26(1) InsO.

Omnilex headnote

InsO § 26 Abs. 1; even where an insolvency opening ground exists, the court must refuse to open proceedings if the debtor’s assets are unlikely to cover the costs of the proceedings. The statutory insufficiency-of-assets bar therefore independently prevents opening; the existence of an opening ground does not overcome the shortfall in assets.
