Leitsätze

Der Eigentümer eines total beschädigten Fahrzeugs kann grundsätzlich Nutzungsausfall nur für den Zeitraum vom Schädiger beanspruchen, in dem ihnm die Beschaffung eines gleichartigen und gleichwertigen Ersatzfahrzeuges auf dem Gebrauchtwagenmarkt bei unverzüglichen Bemühungen möglich gewesen wäre.

Die Beweislast dafür, dass die Widerbeschaffung innerhalb eines kürzeren Zeitraums möglich gewesen wäre, trägt der Schädiger.

Tenor

Die Beklagte wird verurteilt, an die Klägerin 2.891,00 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 16.12.2014 zu zahlen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist gegen Sicherheitsleistung in Höhe von 110% des jeweils vollstreckbaren Betrages vorläufig vollstreckbar.
