Tenor
Der Beklagte wird verurteilt, an die Klägerin 2.890,00 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz aus 2.235,00 € seit dem 26.08.2016 und aus weiteren 656,00 € seit dem 13.10.2017 zu zahlen.
Es wird festgestellt, dass der Beklagte verpflichtet ist, nach dem Fällen, Entsorgen, Roden sowie nach der Neuanpflanzung der Kiefer auf dem Grundstück Lstr. ## in ##### C der Klägerin hierdurch entstehende Mehrwertsteuer bis zu einer Höhe von 185,00 € für das Fällen, Entsorgen und Roden sowie bis zu einer weiteren Höhe von 364,00 € für die Neuanpflanzung der Kiefer zu ersetzen.
Die Kosten des Rechtsstreits werden dem Beklagten auferlegt.
