Omnilex summary

The applicant challenged the court officer’s refusal of advisory legal aid for the matter “Q../. B.” The Bochum Local Court treated the challenge as a permissible reminder and allowed it. It found that the applicant had now sufficiently substantiated his financial need. The possibility of seeking interim relief before the social court did not replace lawyer’s advice: pursuing that route without legal assistance was not reasonable for an ordinary person in the applicant’s position. The refusal was set aside, advisory legal aid was granted for the stated matter, and out-of-court expenses were not reimbursed.

Omnilex headnote

§ 6(2) BerHG; availability of interim relief before a social court and the reasonableness of obtaining legal advice. The possibility of seeking provisional judicial protection does not, by itself, exclude entitlement to advisory legal aid. The relevant question is whether the alternative can reasonably be pursued by the applicant without a lawyer. Where doing so would be unreasonable for an ordinary person in the applicant’s circumstances, that procedural possibility is not an adequate substitute for legal advice. The applicant must also sufficiently substantiate and make credible the need for assistance.

Normen: §§ 11, 24 a RpflG, § 6 Abs. 2 BerHG

Tenor

The applicant qualified because he sufficiently substantiated his financial need, and pursuing interim relief in the social court without a lawyer was not a reasonable alternative.

The applicant had adequately established his need. A layperson could not reasonably be expected to pursue social-court interim relief without legal assistance instead of receiving advice from a lawyer.

Out-of-court expenses were not reimbursed.
