Omnilex summary

The applicant sought advisory assistance for advice about a qualified employment reference after receiving advice concerning a dismissal-protection claim. The Bochum Local Court rejected her reminder against the refusal of that assistance. It treated the consultations as one matter: under § 15(5) RVG, they would be separate only if more than two years had elapsed. Although invited to provide dates and information about the consultation periods, the applicant did not do so, and the court assumed the interval was shorter than two years. Extrajudicial expenses were not reimbursed.

Omnilex headnote

§ 15(5) RVG; distinction between one matter and separate matters for advisory services. Consultations concerning different legal consequences of the same underlying situation constitute one matter where they are substantively connected. They count as separate matters only if more than two years have elapsed between the consultations. A party asserting that the consultations occurred more than two years apart must provide the relevant dates or other substantiating information; absent such evidence, the court may proceed on the assumption that the statutory interval was not exceeded.

Tenor

The two consultations constituted one matter because the applicant did not establish that more than two years elapsed between them.

Under § 15(5) RVG, separate matters arise only if more than two years passed between consultations. Despite the court's notice, the applicant supplied no dates or information about the relevant periods; the court therefore assumed the interval was shorter.

Extrajudicial expenses are not reimbursed.
