Omnilex summary

Bocholt District Court rejected as inadmissible the defendant's objection to its default judgment of 4 September 2012. The court stated that certificates recording service of the complaint or a default judgment are public documents and provide full proof of the facts they attest to unless their inaccuracy is fully proven. The defendant was ordered to bear the further costs of the proceedings. The judgment was declared provisionally enforceable.

Omnilex headnote

Certificates of service are public documents and carry full evidentiary force as to the facts recorded in them. That evidentiary effect persists unless the document's inaccuracy is fully proven; mere doubt or a contrary assertion does not suffice to displace the proof. This principle applies to certificates documenting service of a statement of claim as well as service of a default judgment.
