Omnilex summary

The Bottrop Local Court ordered the father's contact with his two sons under a recurring schedule: alternate weekends in odd-numbered weeks, alternate Friday visits in even-numbered weeks, specified religious holidays, and up to two consecutive weeks during the main holidays by parental agreement. The father generally must transport the children himself. If a parent seeks a change or cannot attend, the parents should try to agree, potentially after seeking advice from the SkF; otherwise, the ordered schedule applies. N's birthday that year was to be spent with the mother, with the scheduled contact moved to 11 September. Court costs were divided equally, extrajudicial costs were not reimbursed, and the procedural value was set at €3,000.

Omnilex headnote

BGB § 1684; determination of parental contact: The court may specify the time and practical arrangements for contact between a parent and child, including recurring intervals, holiday periods and responsibility for transporting the child. A provision requiring parents to consult each other and seek an amicable solution to proposed changes does not displace the court-ordered schedule where agreement is not reached; the prescribed arrangement remains operative. The order may also address a particular date-specific adjustment and allocate procedural costs.

Normen: BGB § 1684

Tenor

a)
