Omnilex headnote

BGB §§ 280(1), 281, 611(1), 823(1); limits of a physician’s duty to provide information. A physician’s disclosure obligation does not extend to explaining or advising on the patient’s legal relationship with a social insurance provider or health insurer. The duty to inform in the physician-patient relationship is therefore distinct from any information obligations that may arise within the patient’s relationship with the relevant social insurance institution or health insurer.
