The Castrop-Rauxel Local Court convicted the accused of negligently exceeding the speed limit and imposed a €15 fine. The decision concerned a speed measurement made with a Leivtec XV3 device, which the court treated as a standardized measurement method. The court held that the defense was not entitled to an expert report merely by challenging the measurement or alleging that the authorities had selected photographs arbitrarily. Concrete indications of measurement error, procedural non-compliance, or arbitrary conduct were required. The accused was also ordered to pay the costs of the proceedings and necessary expenses.

Omnilex headnote

A measurement made with the Leivtec XV3 constitutes a standardized measurement method. In a judgment based on such a measurement, the trial court generally need identify the method used, the measured speed, and the tolerance deduction. It need discuss compliance with procedural requirements or measurement errors only where concrete indications of non-compliance or specific measurement errors have been raised. If the operating manual addresses the measurement situation in question, a defense request for an expert opinion need not be granted without concrete grounds indicating an error. An allegation that the administrative authority arbitrarily selected measurement photographs is likewise insufficient unless the defense identifies concrete supporting circumstances or those circumstances are apparent from the file.

Anlage 2, 49 StVO, 24 StVG, 11.3.1 BKat).
