Tenor
hat das Amtsgericht Düsseldorf aufgrund der am 6. März 1997
geschlossenen mündlichen Verhandlung durch den Richter am
Amtsgericht X
für R e c h t erkannt:
Die Beklagte wird verurteilt, an den Kläger 2.648,20 DM nebst 4 %
Zinsen seit dem 5. Juni 1996 zu zahlen.
Die Kosten des Rechtsstreits fallen dem Kläger zu 40 %, der Beklagten
zu 60 % zur Last. Ausgenommen von dieser Kostenverteilung sind die
durch die Beweisaufnahme verursachten Kosten unter Einschluß der in
dem selbständigen Beweisverfahren XXX AG X
entstandenen Kosten, die alleine die Beklagte zu tragen hat.
Das Urteil ist für den Kläger vorläufig vollstreckbar gegen Sicherheits-
leistung in Höhe von 6.700,-- DM.
Für die Beklagte ist das Urteil vorläufig vollstreckbar ohne Sicherheits-
leistung. Dem Kläger bleibt allerdings nachgelassen, die Vollstreckung
abzuwenden durch Sicherheitsleistung in Höhe von 550,-- DM, wenn
nicht die Beklagte vorher in derselben Höhe Sicherheit leistet.
Der Streitwert beträgt:
bis zum 29. Dezember 1996 7.092,61 DM
ab dem 30. Dezember 1996 2.648,20 DM.
