hat das Amtsgericht Düsseldorf
auf die mündliche Verhandlung vom 9. Juli 1997
durch die Richterin am Amtsgericht X
für R e c h t erkannt:
Die Beklagte wird verurteilt, an den Kläger DM 706,25 nebst 4% Zinsen seit dem
23.01.1996 zu zahlen.
Im übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 65 %, die Beklagte zu 35 %.
Das Urteil ist vorläufig vollstreckbar.
Die Parteien können je die Vollstreckung seitens der anderen Partei durch
Sicherheitsleistung in Höhe von 120 % des beizutreibenden Betrages abwenden,
wenn nicht die je andere Partei vor der Vollstreckung Sicherheit in gleicher Höhe
leistet.
Die Sicherheitsleistung kann durch Vorlage einer unbefristeten, selbstschuld-
nerischen Bürgschaft eines als Zoll- oder Steuerbürgen zugelassenen Kredit-
instituts erbracht werden.
