Das Versäumnisurteil vom 18.04.1997

wird teilweise aufrechterhalten und

wie folgt neu gefasst:

Die Beklagte wird verurteilt, an die

Klägerin DM 455,59 nebst 4 % Zinsen

seit dem 16.02.1997 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Klägerin trägt vorab die durch

ihre Säumnis im Termin vom 18.04.1997

entstandenen Kosten;

Im übrigen trägt die Klägerin die

Kosten des Rechtsstreits zu 45 %, die

Beklagte zu 55 %.
