Der Beklagte und Widerkläger wird verurteilt, an die Klägerin 175,06 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 20. März 2003 zu zahlen.
Der Kläger und Widerbeklagte wird verurteilt, Auskunft zu er-
teilen über die zum Beklagten und Widerkläger bei dem Klä-ger und Widerbeklagten gespreicherten personenbezogenen Daten, über die Herkunft dieser Daten sowie über Empfänger oder Kategorien von Empfängern, an die diese Daten weiter-gegeben werden, ferner über den Zweck der Speicherung.
Im Übrigen wird die Widerklage abgewiesen.
Die Kosten des Rechtsstreits trägt der Beklagte und Wider-kläger zu 58 %, der Kläger und Widerbeklagte zu 42 %.
Das Urteil ist vorläufig vollstreckbar.
Von einer Darstellung des Tatbestandes wird gemäß § 313 a Abs. 1 Satz 1 ZPO abgesehen.
