Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 2. Juli 2003

durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 217,71 EUR zuzüglich Zinsen

in Höhe von 5 Porzentpunkten über den Basiszinssatz seit dem

10.09.2002 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits trägt die Beklagte 7 %, im Übrigen

trägt sie der Kläger.

Das Urteil ist vorläufig vollstreckbar.

Der Kläger kann die Vollstreckung des Urteils (wegen der Kosten)

abwenden, wenn er Sicherheit in Höhe von 1.000,-- EUR leistet, die auch

durch Bankbürgschaft erbracht werden kann, wenn nicht die Beklagte

vor der Vollstreckung in gleicher Weise Sicherheit leistet.

Die Beklagte ihrerseits kann wegen der möglichen Anschlussberufung

Sicherheit zur Abwendung der Vollstreckung in Höhe von 330,-- EUR

leisten, die ebenfalls durch Bankbürgschaft erbracht werden kann,

wenn nicht der Kläger vor der Vollstreckung in gleicher Weise Sicher-

heit leistet.
