Die Beklagte wird verurteilt, an den Kläger 324,80 € nebst Zinsen in Höhe von fünf Prozentpunkten über den jeweiligen Basiszinssatz seit dem 3.6.2006 zu zahlen.

Im Übrigen wird die Klage abgewiesen.
