hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 14.08.2007

durch die Richterin am Amtsgericht X

für Recht erkannt:

Die Beklagte wird verurteilt, die Freigabe des beim Amtsgericht X

zum Aktenzeichen XXX hinterlegten Betrages in Höhe von 54,63 €

an die Klägerin zu bewilligen.

Die Beklagte wird weiterhin verurteilt, an die Klägerin Zinsen in Höhe von 5

Prozentpunkten über dem jeweils gültigen Basiszinssatz aus 54,63 € seit

dem 05.07.2002 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Klägerin trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar. Der jeweilige Vollstreckungsschuldner

darf die Vollstreckung durch Sicherheitsleistung oder Hinterlegung in Höhe

von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht der

jeweilige Vollsteckungsgläubiger vor der Vollstreckung Sicherheit in gleicher

Höhe leistet.
