hat das Amtsgericht Düsseldorf

im schriftlichen Verfahren gem. § 128 Abs. 2 ZPO

mit einer Erklärungsfrist bis zum 26.11.2007

durch den Richter X

für Recht erkannt:

Der Beklagte wird verurteilt, an die Klägerin 3.340,80 € nebst Zinsen in Höhe von 8 Prozentpunkten über dem Basiszinssatz aus 1.670,40 € seit dem 15.06.2006 sowie aus weiteren 1.670,40 € seit dem 15.06.2007 sowie außergerichtliche Kosten in Höhe von 127,45 € nebst Zinsen in Höhe von 8 Prozentpunkten über dem Basiszinssatz seit dem 01.03.2007 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 120% des jeweils zu vollstreckenden Betrages
