auf die mündliche Verhandlung vom 21. Dezember 2007
durch den Richter am Amtsgericht X
für R e c h t erkannt:
Es wird festgestellt, dass das Mietverhältnis zwischen den Parteien über die 4-Zimmer-Wohnung im 2. und 3. Obergeschoss des Hauses X-Weg 9 in X durch die Kündigung der Klägerin von November 2006 zum 31.01.2007 sein Ende gefunden hat.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt die Beklagte.
Das Urteil ist vorläufig vollstreckbar.
Die Beklagte kann die Zwangsvollstreckung durch die Klägerin gegen Si-cherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages ab-wenden, sofern die Klägerin vor der Vollstreckung nicht Sicherheit in gleicher Höhe leistet.
Die Sicherheitsleistung kann auch durch die selbstschuldnerische Bürgschaft einer deutschen Bank oder Sparkasse erbracht werden.
