Die Beklagte wird verurteilt, an den Kläger 2.282,40 € nebst Zinsen in Höhe von

fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 18.10.2008 zu

zahlen; im Übrigen wird die Klage abgewiesen.

Die Beklagte hat die Kosten des Rechtsstreits zu tragen.

Das Urteil ist gegen Sicherheitsleistung in Höhe von jeweils 110 % des jeweils

zu vollstreckenden Betrages vorläufig vollstreckbar
