für Recht erkannt:

Die Klage wird abgewiesen.

Auf die Widerklage wird die Klägerin verurteilt, an den Beklagten 555,60 € zu zahlen.

Es wird festgestellt, dass der Klägerin aus dem Internet-System Vertrag ohne Datumsangabe, gekennzeichnet mit der No. xxx, für das dritte Vertragsjahr keine Rechte zustehen.

Im Übrigen wird die Widerklage abgewiesen.

Die Kosten des Rechtsstreits trägt die Klägerin.

Das Urteil ist vorläufig vollstreckbar. Die Klägerin darf die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht der Beklagte vor Vollstreckung Sicherheit in gleicher Höhe leistet.
