für R e c h t erkannt:

Die Beklagte wird verurteilt, an die Klägerin 180,86 € nebst Zinsen in Höhe von 5%-Punkten über dem Basiszinssatz seit dem14.05.09 sowie 39,00 € vorgerichtliche Rechtsanwaltskosten nebst Zinsen in Höhe von 5%-Punkten über dem Basiszinssatz seit dem 29.05.09 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 55% und die Beklagte zu 45%.

Das Urteil ist vorläufig vollstreckbar.

Der Streitwert wird auf 388,17 € festgesetzt.
