Tenor

für Recht erkannt:

Der Beklagte wird verurteilt, an die Klägerin 855,60 EUR nebst 5 % Zinsen über dem Basiszinssatz seit dem 22.11.2008 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits tragen die Klägerin 38 % und der Beklagte 62 %.

Das Urteil ist vorläufig vollstreckbar.

Dem Beklagten wird nachgelassen, die Zwangsvollstreckung gegen Sicher-heitsleistung von 120 % des ausgeurteilten Betrages abzuwenden, es sei denn, die Klägerin leistet vor der Vollstreckung Sicherheit in gleicher Höhe.

Der Klägerin wird nachgelassen, die Zwangsvollstreckung gegen Sicherheitsleistung von 200,00 EUR abzuwenden, es sei denn, der Beklagte leistet vor der Vollstreckung Sicherheit in gleicher Höhe.
