für R e c h t erkannt:

Es wird festgestellt, dass der Unfallversicherungsvertrag zwischen den Parteien mit der Versicherungsscheinnummer xxxxxxx zum 1.7.2009 wirksam durch Kündigung vom 4.2.2009 zum 1.7.2009 beendet ist.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagte darf die Zwangsvollstreckung des Klägers durch Sicherheitsleistung in Höhe von 110 % des jeweils beizutreibenden Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in gleicher Höhe leistet.

Die Sicherheitsleistung kann auch durch die Bürgschaft nach § 108 Abs. 1 ZPO eines in der EU als Zoll-/Steuerbürgen zugelassenen Kreditinstituts erbracht werden.

Die Berufung wird zugelassen.
