Die Beklagten werden als Gesamtschuldner verurteilt, an den Kläger 255,97 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 16.7.2010 zu zahlen, sowie den Kläger von seiner Zahlungsverpflichtung gegenüber seinen Prozessbevollmächtigten für die außergerichtliche Vertretung in Höhe 179,75 € freizustellen.
Die Klage im Übrigen wird abgewiesen.
Die Kosten des Rechtsstreits werden gegeneinander aufgehoben.
Das Urteil ist vorläufig vollstreckbar. Den Parteien wird nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des jeweils beizutreibenden Betrages abzuwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
